    When can we change job? just after filing for 485. Or we have to wait for EAD and then only can change the job?

    We (parents) had applied for family based concurrent AOS in Aug, 2008 while we were on

    tourist visas. We are now in India on Advance Parole(valid till Aug. 2009) that we received

    after filing AOS.

    Today(Feb, 2009) production of green card has been ordered for my wife and will soon be

    received in USA. My case is still pending but we expect it processed soon. Thanks for all

    the help.

    My questions is

    (a) What documents we need to show at immigration on returning to USA?. We have I-485

    Notice, Advance Parole and valid Passports.

    (b) Do we need to request somone in USA to mail our green cards on receipt.?

    (c) How much maximum time we still can stay in India.? We wish to stay here for another 1-2

    months. In any case making travel arrangements etc. is likely to take atleast 2 weeks.

    (d) But is there a time limit for returning?

    (e) Can we safely enter 2-3 months after the cards are received in USA, and

    (f) sending GC by mail is not objectionable?


    Also, in totality, Which one of these scenarios is correct:

    1) Do we have to return immediately on approval of green card, enter with advance parole

    only and it is not legal to mail green cards?

    OR

    2) It means if we can get our cards mailed and receive it here, we can safely travel back

    with our green cards, even after 2 months of its receipt in USA. Overstay abroad is not an

    issue whether it is 2 weeks, 2 months or even more. Am I right?

    We would appreciate all the help here, as these are some of the question I have looked over

    many sites and forums but could not find answers to. Thanks so much!

    I think it is only for Mumbai Consulate(as mentioned in VFS (http://www.vfs-usa.co.in)).

    "For Mumbai consular district applicants only: Drop off your required documents three working days prior to your appointment at a VFS Application Centre in Mumbai, Pune or Ahmedabad."

    No where it is mentioned that HYD consulate has started. Where did you find it?

    you can also change employers immediately. Your spouse is the primary applicant, and hte 180 day AC21 rule applies to her. You can:
    - use EAD whenever you want
    - change jobs whenever you want
    - change job profile however you want.

    she:
    - can use EAD whenever she wants
    - change jobs after 180 days
    - change onto a job in the same or similar profile.

    My Permanent residency is being processed thru Employer A (I-140 not done yet).
    Employer A also holds my H1B. This is my only H1B, and it extends based on approved labor as I am on my 7th year if H1B.

    If A files for Chapter 11, will my H1B and permanent residency get cancelled/revoked?

    If my current H1B is valid till Nov 2010, and employer A files for chapter 11 in Dec 2010, will I be able to stay/work in US at least till Nov 2010?

    What will be my options if H1B / GC gets cancelled? Can I transfer this H1B to a different employer? Or, can a different employer has to file for a new H1B? :confused:

    Your answer/advices are highly appreciated.

    GC/H1 sponsoring employer filing Ch11 has no implications on your current H1 or pending GC until the company starts liquidating (files Ch7). I have been in the same situation and I just recently used AC21 and changed employers by transferring my H1 to my new employer. Original company has been in Ch11 since Jan'09. My 8-11 yrs H1 extension (based on approved I-140) with my original company was pending when they filed Ch11 and USCIS had no issues approving it in Mar. As long as your current position is not eliminated (laid off), there is no problem. It will definitely be an issue if the company announces Ch7 liquidation before you can transfer to a new employer. Once the company is in Ch7 and USCIS figures it out, then it could revoke your H1 or send a NOID on your I-485. Hope this helps.

    I agree with you. They talk a lot ,but no action !! It is disappointing.
    We have to do something to get the SKILL Bill on the table. What IV is doing to push this BILL ? any comments from Core Team ?

    My H1B 6 yr limit is set to expire in July 2008. I have an EAD/AP from filing in July. I want to invoke AC21 and change jobs using EAD. I hear a lot of people mention about keeping your H1B visa just in case the I-485 application gets rejected. But even if I extend my H1, it will be based on the fact that I have applied for I-485 since I am over the 6 yr limit. In that case, won't my H1 extension be void too if the I-485 gets rejected. I am not really sure how maintaining H1B/EAD together helps people in my situation. ANy thoughts/inputs welcome.

    You extend you H-1B (< 6yrs) based on approved PERM and/or approved I-140. So if your I-485 was rejected, your H-1B would be safe. However, if your employee or USCIS revoked the approved PERM/I-140, then I don't know what would happen to the extended H-1B.

    If you invoked EAD and USCIS rejected your I-485, you would lose the EAD as well as the I-485 pending status because EAD was granted on your pending I-485 status.

    It's news to me. Injection molded connectors are easy to produce while maintaining tight tolerances, so I'm skeptical of that warning.

    Many people have had pictures lost even with "good" cards, so that claim sounds more like a scare tactic.

    Personally, I think I'll continue to go with SanDisk Extreme, as they have really good warranty (lifetime guarantee). I'm also concerned with knowing I have honest specs so I"m getting the data rates claimed for the product.

    According to Interfoto the cheap memory cards doesn't fit too well physically and can damage the camera. Their service department report pins that are either broken or even forced into the camera itself.

    In addition there has been problems with pictures disappearing when "the card crash".

    Interfoto recommends Sandisk and Lexar, as well as Microdrives from IBM/Hitachi. (Interfoto is the Norwegian Lexar distributor btw)

    Has anyone else heard something similar?

    Does any one got "AP" approved, who applied in the month of august?from NSC.

    Hi,

    I filed my 140/485/EAD/AP on Aug 17th, Got receipts on Oct 30,
    EAD card received on Nov 9, AP travel doc received on Nov 14th.
    FP Notice received on Oct 30, scheduled for Nov 27.

    H1 with company (X) was denied on May 2008, but made appeal to it and its in the process.
    during the same time
    i have applied for H1 transfer to company (Y) through consular processing. I got approval.
    If i go for Visa Stamping would it be a problem. Live around Ca. planning to go for Tijuana, Mexico.
    also
    Company (y) says it won't generate pay stubb unless u get visa stamped. Do i really need pay stubb(s) with
    company(Y) in order to go for stamping.or its okay to go with company (X) paystubs.
    My paystubs are still with company (x) till month of May 2008.
    how good are chances of getting visa if im going for stamping in month of July, 2008

    pls advice... what should i do in the situation i'm in

    I filed I-485 in July 2007 through my employer (EB3 with Priority date - 02/2004) and my wife filed her I-485 adjustment of status at the same time. We don't have our H-1 visas anymore and using EAD & AP for employment and travel.

    We want to adopt a child in India as Inter-country adoption (as a Indian resident). For this, my wife have to travel to India and stay with the child for two years from the date of guardianship.

    As there is no Green Card in sight for EB-3:

    1. If she stays in India for two years, will it affect her I-485 application? If yes, how can we avoid that - like travel back to US once in a while etc.

    2. As per US Immigration law, the parent(s) has to stay with the adoptive child for two years. Assuming that my wife stays with the child for 2 years in India, will the child get a visa so that we can bring the child to US? or do we need to file a I-485 for the child? What happens if my GC is approved within that 2 year period? Can we still bring the child to US? On what type of visa/status?

    Appreciate any help in this regard.

    I am currently unemployed and my spouse needs to travel to Mumbai urgently. Our AP is valid through November 30, 2009. Will there be any issues for my wife when she comes back - possibly because of my current status. Wife is employed (with a different company)& the EAD/AP was filed by my last employer. Responses will be appreciated. Thanks!
    an EAD requires a sponsoring company. So, it is in your best interest to find an employer immediately and apply for AC21. If at the time of renewal they ask for employer documents, then your renewal will not be processed and your EAD/AP withdrawn.
